You must make an Application to the Federal
Magistrates Court or Family Court of Australia for property settlement Orders
within 12 months from the date of your divorce, or two years from the date of
your separation if you are not married. If you do not, then you will need to
seek the leave of the Court to commence an Application for Property Settlement
Orders.
We suggest that you attempt to resolve
the financial issues which arise following the breakdown of your relationship
early, and before your time limitation expires. This will give you the option
of negotiating with your ex-partner, and exhausting less adversarial options
before seeking assistance from the Courts.
