We support and encourage our clients to resolve their financial and parenting disputes through the mediation process. Mediaiton is a meeting or series of confidential meetings where the parties, their lawyers and an independent person (the mediator) come together to discuss, negotiate and resolve their dispute.
Overwhelmingly, we find that most of our clients settle their dispute within this process, thanks to the structure provided by the mediator and our negotiation expertise.
Mediation provides you with more control in reaching agreement. It does not impose solutions, instead promoting agreement through assisted discussion and negotiation. It is confidential. It saves you the expense, time and emotional stress of the court system.
If you have a parenting dispute, subject to some exceptions, you must participate in parenting mediation with a dispute resolution practitioner (called "dispute resolution") before you can go to Court. We know some of the best dispute resolution practitioners in Queensland, who, through understanding, legal knowledge and impartiality provide great assistance to our clients in resolving their parenting dispute without the need to go to Court.
Sometimes mediation or dispute resolution is not appropriate. In those circumstances we work closely with our clients to ensure the most appropriate course is adopted. We are always focussed on providing cost effective and appropriate advice to ensure clients are aware and comfortable with the options and processes involved.
